AMG CAR RENTALS AND SALES LTD we respect your privacy. We have implemented this privacy policy (“Privacy Policy”) and cookie policy (“Cookie Policy”) to explain our data collection and use practices. You can learn more in the sections below.
Amgjamaica.com is owned and controlled by AMG Car Rentals and Sales Ltd. (“AMG Car Rentals”, “Amg”, “we”, “us” or “our”). We are sensitive to your concerns about how we use the personal information we collect from someone that accesses, browses, or in any way uses the Services (“You”, “you”, or “User”) through Amgjamaica.com website(s), domains, Applications, or any of its Services (the “Site”). We have implemented this privacy policy (the “Privacy Policy”) and practices to keep your personal information secure, and it describes how we collect and use such information, and the choices you have regarding our use. This Privacy Policy is incorporated into our Terms of Services and therefore governs your use of the Services. BY ACCESSING OR USING THE SERVICES, YOU AGREE TO THIS PRIVACY POLICY. IF YOU DO NOT AGREE TO THIS PRIVACY POLICY, YOU MAY NOT ACCESS OR USE THE SERVICES.
The Information We Collect+
We may collect the following personal information during the registration process (e.g. name, email address, and company name) (“Personally Identifiable Information” or “PII”). We also collect a variety of non-identifying visitor data, much of it automatically, such as IP addresses, browser settings and history, ISP information, referring/exit pages, operating systems, date/time stamps, search inquiries, and clickstream data (collectively “Non-Personal Information”). We use Non-Personal Information to analyze trends, to administer the site, to measure users’ activity on the site and to gather demographic information about our user base as a whole. We do link this automatically-collected data to PII. When referring to both PII and Non-Personal Information collectively, we will refer to it as “User Information”.
Information Collected About You
You may provide us with certain information in connection with a transaction or in your interactions with our websites and at our locations. We collect the following types of personal information from you:
- Your name, contact information, date of birth, driver’s license number and expiration date and emergency contact information;
- Vehicle rental information, including the location of where the vehicle is rented, date of rental, type of rental and your preferences;
- Your credit card details, our rewards information, online user account details, passport information and frequent flyer or travel partner affiliations;
- Information you provide regarding your marketing preferences or in the course of participating in surveys or promotional offers;
- Photographs you submit of you and your driver’s license or your receipts through camera features available on some of our mobile applications and websites;
Third parties provide us with additional information about you, including:
- Referral Sources, such as third party online booking sites (who provide us general contact information and a booking confirmation number to facilitate the rental), your employer (general contact information), and your insurance provider (general contact and policy information).
- Where applicable, our Refer-A-Friend programs.
- Hotel, airline and membership clubs, who provide us your general contact information and booking information.
- Credit reporting agencies, who, for fraud prevention purposes, provide us with identity-related information.
- Franchisees, who provide us information regarding your rental transactions.
- Service Providers, such as customer support (customer service-related information and enquiries made by you), customer survey providers (your response to our customer service surveys) and marketing providers (information to assist us to better communicate our products and services).
With your consent, we will access location-based information or collect location markers from your mobile device or based on your IP address. We will use this information to provide you with notifications related to our locations, return information, local offers or other information that we think will be helpful in providing you with better services. We do not use this information to specifically locate you for any reason other than to provide you the service. With your consent, our application will utilize your device’s camera. If you have allowed us to utilize your location information or your device’s camera in the past and wish to revoke the permissions, please change the settings on your device.
Vehicle Operation and Location Data
Our vehicles may be equipped with a vehicle telematics system (“Telematics System”). Some or all Telematics System functionality will be active during rental periods. Telematics Systems provide us with use of, disclosure of or access to (1) location information, (2) crash notification and related crash data, (3) operational condition, mileage, diagnostic and performance reporting of vehicles and (4) driver behavioral information (“Telematics Data”), as permitted by law.
Use of the Telematics System is subject to the terms and conditions and privacy policy posted by the applicable Telematics Systems provider and/or vehicle manufacturer, which may include system and service limitations, warranty exclusions, limitations of liability, wireless service provider terms, privacy practices, descriptions of use and sharing of information and user responsibilities. We are not responsible for any data that is left in the vehicle as a result of your use. We cannot guarantee the privacy or confidentiality of such information and you must wipe it before you return the vehicle to us.
Telematics Data will be shared with emergency service providers, others who assist in responding to an accident, telematics service operators or those with whom we have a legal or contractual obligation to provide such data.
Cookies, Web Beacons, and Other Technologies+
We may use the standard cookie feature of major browser applications and third-party providers, or employ internally developed cookies and tracking codes, that allows us to store a small piece of data on a User’s computer (or any other device used to access the Services, including a mobile device) about the User’s use of the Site. It’s a text-only string of information that allows us to distinguish you from other Users, but not in a personally identifiable way. We do capture PII in cookies or use cookies to mine PII. If you do not want us to use cookies, you must disable them in your browser. If you choose to do so, you may still use the Site, but your ability to use some of areas and features of the Site may be limited.
We employ technologies such as clear gifs (a.k.a. Web Beacons), tags and scripts to help us better manage content by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track online usage metrics. In contrast to cookies, which are stored on a user’s computer or device, clear gifs are embedded invisibly on web pages. We do tie the information gathered by clear gifs to PII.
Our Services may include links, features or components supplied by third parties, such as the social media links, Google Analytics, or other interactive and customizable tools. Such third parties may have information practices different than those set forth herein and their use of cookies and other technologies is not covered by this Privacy Policy. We do not have access to or control over such third parties, nor are we responsible for it or endorse it. We strongly encourage you to consult the privacy notices provided by those third parties.
How We Use and Share the Information We Collect+
We use PII in solely our ordinary course of business with you, such as communicating with you, processing your requests or orders, or give you access to the Services. We may also use PII to contact you about our products and services, such as promotional emails and technical announcements about the Site. Please note you may opt-out of promotional emails but not technical or service-related emails (unless you terminate your account).
We use Non-Personal Information for our internal business purposes including, without limitation, to provide AMG Car Rentals and Sales Ltd with statistics on how the Services are used, to help us detect and measure errors in the Services, to provide, understanding, and enhance the Services for you (including improving your individual experience with the Services), and for marketing purposes.
We may share some of all of your User Information (collectively with our subsidiaries, joint ventures, affiliates, or other companies under common control that we have or may have in the future, provided such party undertakes to protect your privacy in accordance with this Privacy Policy. We may also share your Information with third parties who perform services for AMG Car Rentals and Sales Ltd (“Service Providers”), as specified below. Such Service Providers are prohibited from using your Information other than to provide services to us.
We may disclose your User Information without notice to you if we conclude that it is required by law, such as to comply with a subpoena or similar legal process, or when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request. Notwithstanding anything herein, we reserve the right to use and disclose anonymous data to third parties in our discretion. We may also transfer User Information if AMG Car Rentals and Sales Ltd is merged, acquired, sold, or if some or all of our assets or equity are transferred.
We do not response to Do Not Track (“DNT”) signals, and we do not store credit card details with any third parties.
Other than as set forth herein, we will not share, rent or sell your User Information to a third party.
We use the information we collect from you or about you to provide you with our services and for the following purposes:
- Where it is necessary for us to enter into a contract with you and provide services to you for the duration of the contract, including
- To assist the transactions that you request, such as reserving, renting, purchasing or leasing motor vehicles.
- To provide customer service related to your interactions with us or to respond to your enquiry.
- To enroll you in our loyalty programs and send non-promotional information relating to your ongoing membership of these programs.
- Where necessary for us to comply with a legal obligation, including
- To share information about your vehicle’s location with emergency services in the event that you are involved in a road accident.
- To share information with government and regulatory authorities when required by law or in response to legal process, obligation, or request.
- Where it is necessary for our legitimate interests, as listed below, and where our interests are not overridden by your data protection rights, including
- To communicate important information about your rental, such as arrival and return alerts. These communications, which are transactional in nature, will be sent to you via email or SMS.
- To assist us in providing better products and services: for example, to evaluate the performance of our staff, to assess the quality of products and services received and to help us improve our websites, facilities and services.
- To compile statistics and analysis about our customers’ use of our websites, products and services. These statistics are used only to enable us to provide better customer service, products, features and functionality to you and other customers in the future.
- To develop a profile of you and your interactions with us so that we can provide tailored offers, opportunities and services that may be of interest to you.
- To protect our legal rights and manage the security of our networks and property. For example, we will use CCTV to ensure the security of our premises and we maintain Do Not Rent lists of customers that are non-payment or safety risks.
- To share your information with third parties in order to prevent fraud and protect our business interests and rights, privacy, safety and property, or that of the public. We will do this to collect unpaid bills, to avoid liability for penalties you incur (e.g. traffic citations) and for claims processing purposes.
- To share your information with third parties in order to permit us to pursue available remedies or limit damage that we may sustain and to enforce the terms of any rental agreement or our websites’ terms and conditions. We will also disclose your information to third parties if the rights of another individual may be violated.
- To enable us to use telematics (e.g., for the purposes of tracking mileage and location in the event of theft and to alert us if the telematics systems has been removed or tampered with).
- Where you have given consent, including
- To assist us in providing you with the most appropriate vehicles, such as those with adaptive driving devices. In some cases, this will require us to infer or explicitly collect information about your health or physical condition.
- To send you certain promotional or targeted marketing communications, opportunities and services that may be of interest to you. These will include invitations to join our loyalty programs, upgrade announcements, electronic newsletters and communications regarding an incomplete online membership form or reservation. Some of these offers will be received in advertising on non-Amg car rentals sites, including on social media.
- To send you text messages in order to provide you with time sensitive communications related to your transaction (e.g., construction delay at airport branch), extended rental opportunities, customer experience surveys, marketing promotions such as coupons, discounts, last-minute specials or loyalty and rewards information.
Retention of Your Personal Information
We retain your personal information for as long as we need to fulfill our business purposes, as set out below:
- Marketing purposes: We keep data linked to cookies and other online identifiers up to three years. We keep other marketing information, such as email subscription and loyalty enrollment data for up to 7 years after your last interaction with us.
- Rental transactions: We keep the data associated to your rental agreement for up to 7 years from the date of the rental, subject to other local legal requirements. We keep records of payments you have made for 2 years from the date of the transaction (depending on the location of the rental).
- Customer service related queries: We keep general queries for 3 years, unless you make a complaint, in which case, we keep complaints data for 7 years.
- Disputes & law enforcement: If we are involved in litigation or a governmental or regulatory investigation, then we keep data throughout the period of litigation or investigation and for 5 years after that. If a settlement means that we have to keep data for longer, then we keep data for the period required to administer the settlement. If we provide data to law enforcement agencies, then we keep a record of this for one year beyond the end of the investigation.
Who We Share Information With
Subsidiaries
We share the information we collect from and about you with our subsidiaries for the purpose of providing the transactions you have requested and (with your consent) for marketing purposes. See the Subsidiaries page for a list. The list is subject to change from time to time and you should periodically review it for changes. Our subsidiaries’ employees in our IT, marketing, operations and customer service divisions will use your information, as described in this Privacy Policy, including, if required by applicable law, to send you information about products and services or respond to your inquiry.
Franchisees
The nature of the business and operations require us to share your reservation and booking information with our franchisees (“Franchisees”). See the Franchisees page for a list. The list subject to change from time to time and you should periodically review it for changes. For these transactions, the Franchisee is an independent data controller or equivalent under applicable law and will maintain its own privacy policy in respect of the rental data that you provide to the Franchisee. You are encouraged to check the privacy policy of the Franchisee that is applicable to your transaction.

Our Service Providers And Business Partners
We will share your information with third parties, such as (1) payment, administrative and technical support providers or our insurance replacement, corporate rental or other customers or partners to facilitate the rental transaction and rewards programs with Amg car rentals group members, (2) companies who conduct customer research or satisfaction surveys on our behalf, (3) communication providers which send email and other marketing and service-related communications to you on our behalf, (4) customer support providers, such as the provider of our live chat feature, in order to provide you customer service, (5) debt collection providers, (6) claims processors, and (7) our advertising and marketing partners and third-party media properties, including social media sites, with whom we share aggregated or de-identified information about our customers, to allow them to send targeted advertising messages on our behalf, to analyze, enhance and manage our data, conduct mobile analytics services and to maintain and improve our services (subject to confidentiality agreements as appropriate).
Government Authorities
Your personal information may also be shared with government authorities as outlined above.
Sale, Merger or Change in Control
Your information may also be transferred to another company in the event of a transfer, change of ownership, reorganization or assignment of all or part of Amg car rentals’ businesses or assets. This will occur if the parties have entered into an agreement under which the collection, use and disclosure of the information is limited to those purposes of the business transaction, including a determination whether or not to proceed with the business transaction. You will be notified via email or prominent notice on our websites for thirty (30) days of any such change in ownership or control of your personal information or as otherwise may be required or permitted by law.
Testimonials
We may post customer testimonials on our websites which may contain personal information. We use a third-party provider to manage this process. This provider is responsible for obtaining your consent as necessary, removing content upon your request and answering any questions you may have.
Service Providers+
We work with third parties to provide Users with the best customer experience. As such, User Information may be provided in certain circumstances to third parties to carry out tasks on our behalf for the purpose of maintaining, operating, providing and improving the Services (e.g., billing, emailing, CRM, support, analytics, and data storage). When third parties carry out the task on our behalf, we implement restrictions that prevent such User Information from being used or shared except as directed by us, including that they are subject to and in compliance with our Terms, Privacy Policy and have appropriate confidentiality and security measures in place. These companies are authorized to use User Information only as necessary to provide services to us. You hereby acknowledge and consent to such use by using the Services.

We the owner of Amgjamaica.com (“Site”) may include links to third-party websites or mobile apps. and other websites may maintain links to our Site. Our inclusion of such links on any linked website or mobile app is not an endorsement, authorization or representation of our affiliation with any such third parties, and we are not responsible for any information you may share with such third party linked website or mobile app, nor are we responsible for their privacy practices or policies, which you agree to by accessing their sites.
Global Data Transfers and Processing+
Your Information may be processed by AMG Car Rentals and Sales Ltd or Service Providers in the country in which it was collected or entered (“Original Country”). AMG Car Rentals and Sales Ltd or Service Providers may also transfer your Information to countries other than the Original Country. Such other countries may have different data protection laws than the Original Country and you expressly agree to such processing and transfer.
In order for us to operate and provide you services globally, the information you provide us or that we collect may be transferred or accessed by entities around the world, including:
- Franchisees/Corporate-Owned Locations: If you book a reservation to be fulfilled by a franchisee in another country or an Amg corporate-owned location (e.g., in The United States), we will transfer your personal information to that country in order to facilitate your requested transaction.
- Amg Global Information Systems Based in Jamaica: Amg maintains its global information systems in Jamaica. If you provide us or if we collect personal information about you outside Jamaica, we will transfer and maintain your personal information in Jamaica.
With respect to information received or transferred pursuant to these Frameworks, we are subject to the regulatory enforcement powers of the Jamaican Government. In certain situations, we may be required to disclose personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
Amg is responsible for the processing of personal data it receives, and subsequently transfers to a third party acting as an agent on its behalf. Amg complies with the Privacy Principles for all onward transfers of personal data, including the onward transfer liability provisions.
Under certain conditions, more fully described on our Privacy Policy page, you may invoke binding arbitration when other dispute resolution procedures have been exhausted.
- Third Party Service Providers: We utilize third party service providers who are located outside the countries where we have corporate-owned locations, such as call center support, claims processors and IT providers.
Your Rights
Other rights you have may include: 1) asking for a copy of your personal information, 2) to correct it, 3) to erase certain categories or types of information, 4) to restrict certain processing, 5) to obtain the information you provide in a structured, machine readable format and 6) to transfer some of this information to other organizations.
You have the right to object to processing of personal information on the basis of our legitimate interests. Where we have asked for your consent to process information, you have the right to withdraw this consent at any time.

We reserve the right not to allow access to your information or to limit your rights (e.g. if such disclosure is prohibited by law or if the rights of another individual might be violated). In some instances, this may mean that we are able to retain your personal information even if you withdraw your consent.
Marketing Preferences
You have the right to object to direct marketing as well as profiling we perform for the purposes of direct marketing. You will be able to opt out of direct marketing communications from Amg car rentals and our subsidiaries affiliate and Franchisees by following the instructions in each communication you receive. You can opt out of display ads you see on non-Amg sites by clicking on ad choices icon in the ad or through the privacy settings on the site.

AMG Car Rentals and Sales Ltd employs a variety of security technologies and procedures designed to help prevent unauthorized disclosure of, access to and use of Information that we collect or receive. However, we cannot guarantee the security of your Information. Accessing, Changing and Deleting Your Account+

Please note that we have the right to reject deletion requests that are unduly burdensome or repetitive or that cannot be honored in light of legal obligations or ongoing disputes, or where retention is necessary to enforce our agreements or protect our or another party’s rights, property, safety, or security.
Our Policy Towards Children+
We do not offer products or services for anyone under 18 (“Child”). If you are a Child, you may not access the Site or Services without the consent of a parent or guardian. AMG CAR RENTALS AND SALES LTD does not knowingly collect personal information from, any child under the age of 18 or your country’s age of minority. If a parent or guardian becomes aware that a Child has provided us with PII, he or she should contact us immediately by email at privacy@amgjamaica.com. If we become aware that a Child has provided us with PII, we will delete such information from our files.
Updates and Changes To These Policies+
We reserve the right as necessary, to revise our Privacy Policy and Cookie Policy or any part of it from time to time to reflect changes in our privacy practices. If we make any material changes, we will notify you by email (sent to the email address specified in your account) or by means of a notice on this site or as otherwise may be required or permitted by law, of material changes prior to the change becoming effective. Changes to this Privacy Policy may affect User Information provided to AMG Car Rentals and Sales Ltd before the revised Privacy Policy.
